DUII Legal Process

Helping You Through the DUII Legal Process

If you are facing charges for a DUII, you are going to need strong legal representation. The process can be extremely complex and it is important that you have a criminal defense lawyer on your side who will fight to protect your interests. At the Hohbach Law Firm, LLC, in Lake Oswego, Oregon, we provide aggressive defense against all types of drunk driving offenses.

It is beneficial to understand how the DUII legal process works and what to expect along the way. The legal process actually happens in two parts: the administrative license hearing and the DUII criminal proceeding. Attorney Sue Lain, formerly Sue Hohbach represents clients in all areas of DUII and other drunk driving-related offenses and works diligently to preserve your rights and your freedom.

Administrative License Hearings

If you fail a breath test, or refuse to take one, your license is subject to automatic suspension. The administrative license hearing, also referred to as a DMV hearing, is your opportunity to fight the validity of the suspension. You must request this hearing within 10 days of your DUII arrest. If you don't, your license will automatically be suspended 30 days after your arrest. It is therefore important that you contact us right away so that we can help you through this process without missing the deadline.

DUII Criminal Proceedings

The date on your citation is the date of your first court appearance. In some jurisdictions, this appearance can be waived if you have hired an attorney. The next step is the pre-trial conference where you reach a plea agreement, enter a diversion program or inform the court of your decision to go to trial. We can advocate on your behalf to negotiate a better plea deal or advocate for a diversion program if you are legally eligible for that option. If you choose to go to trial, we will thoroughly investigate the facts of your case, explore every defense and trial strategy, and put our trial skills to work for you.
