If you are arrested for a first-time drunk driving offense in Oregon, you may be eligible for the DUII diversion program. DUII diversion gives you the opportunity to complete a court ordered program and avoid having a DUII conviction on your record . The requirements for acceptance into the diversion program are very specific and acceptance is not automatic.

How Does DUII Diversion Work?

You will attend a court hearing specifically for the determination of your admission into the diversion program. The court will almost certainly allow you into the diversion program if the deputy district attorney does not object. If there is an objection, you will need to convince the judge that you should be allowed into the program.

If you are accepted into the program, the court will order you to fulfill a list of obligations, such as participating in a substance abuse evaluation and any recommended treatment, attending a victim's panel, not possessing or consuming alcohol, not entering any establishment where the sale of alcoholic beverages is a primary source of income and paying various financial obligations.

You must also keep a clean record for an entire year after being admitted to the program. Immediately upon leaving the courtroom, you will need to either pay the monies owed to the court or arrange a payment plan. You will then need to make your appointment for your substance abuse evaluation. Your evaluator will determine your required level of substance abuse counseling and will assist you in finding an acceptable program. If you successfully complete each of the court's requirements, your case will be dismissed at the end of the one-year diversion period.
