Administrative License Hearings

Working to Preserve Your Driving Privileges

If you have been arrested for a DUII, it is critical that you contact an experienced criminal defense attorney as soon as possible. In addition to the criminal charges you are facing, you also stand to lose your driver's license. Separate from the DUII proceeding is a DMV hearing. The DMV hearing is an administrative proceeding that is only concerned with whether your license should be suspended — not your innocence or guilt of the DUII charge.

These hearings are extremely technical and difficult to win and you should not attempt to represent yourself. Having strong representation on your side is your best bet for preserving your driving privileges. At the Hohbach Law Firm, LLC, in Lake Oswego, Oregon, we work with clients throughout the Portland area who need help with DMV hearing, license reinstatements and related issues.

Fighting to Protect Your Rights

Your license is subject to suspension if you test above a .08 blood alcohol (BAC) content or refuse to submit to a BAC test. If you are a minor, your license is subject to suspension if you show there is any alcohol in your blood whatsoever. If you hold a commercial driver's license, you are subject to enhanced suspension provisions. You only have 10 days from the day of your arrest to request a hearing. If you fail to do so, your license will automatically be suspended after 30 days. We can help you request the hearing and make sure that all deadlines are met.

In order to preserve your driving privileges, we must show that something improper occurred in the process of your arrest. We will challenge the validity of the stop, probable cause, the accuracy of any BAC tests, the proper administration of field sobriety tests and any other issues that should be considered by the judge at the hearing. We will build the strongest possible case on your behalf and work diligently for a positive result.
